1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of the website and services provided by Epic Dreams AI Solutions LLC ("Epic Dreams," "we," "us," or "our"). By using our site or engaging our services, you agree to these Terms. If you do not agree, do not use our services.

For paid engagements, a separate signed order form, statement of work, or master services agreement ("Engagement Agreement") may also apply. Where an Engagement Agreement conflicts with these Terms, the Engagement Agreement controls.

2. Our services

We provide AI business automation services, including voice agents, agentic workflows, custom AI software, and related implementation, integration, training, and managed-operations services. Specific deliverables, timelines, and scope are defined in your Engagement Agreement.

3. Eligibility and accounts

Our services are intended for businesses and the professionals who represent them. You must be able to form a binding contract and be authorized to act for the organization you represent. You are responsible for maintaining the confidentiality of any account credentials and for activity under your account.

4. Acceptable use

You agree not to:

• Use the services for any unlawful, harmful, deceptive, or infringing purpose.
• Attempt to gain unauthorized access to our systems, disrupt the services, or circumvent security or governance controls.
• Use the services to generate or distribute content that violates the rights of others or applicable law.
• Misrepresent AI-generated communications where disclosure is required by law or by the safeguards we put in place.

5. Fees and payment

Fees are set out in your Engagement Agreement or at the point of purchase. Unless stated otherwise, fees are billed in advance, are non-refundable except as required by law or expressly agreed, and are exclusive of applicable taxes.

Payments are processed securely by Stripe; by purchasing you also agree to Stripe's terms. For plans where you bring your own AI provider API keys (BYOK), you are responsible for the costs, terms, and usage limits of those third-party providers. Late or failed payments may result in suspension of services.

6. Intellectual property

Our website, brand, software, models, methods, and documentation — and all related intellectual property — remain the property of Epic Dreams and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the services and deliverables for your internal business purposes as described in your Engagement Agreement.

You retain ownership of the data and materials you provide to us. Ownership of custom deliverables is allocated in your Engagement Agreement. We maintain provenance and IP-protection practices as described on our Trust pages.

7. Your data and confidentiality

Each party agrees to protect the other's confidential information. We handle personal information as described in our Privacy Policy. You are responsible for ensuring you have the rights and any necessary consents to share data with us and to have it processed for your intended use, including compliance with laws applicable to your industry.

8. AI outputs and human oversight

Our services use artificial intelligence. AI outputs can be incomplete, inaccurate, or unexpected. We design for human-in-the-loop review, but you are responsible for reviewing outputs before relying on them for consequential decisions.

Our services do not constitute legal, medical, financial, or other professional advice, and AI assistance is not a substitute for qualified professional judgment. You remain responsible for your use of the services and for outcomes within your operations.

9. Third-party services

The services may integrate with third-party tools and platforms (for example, your CRM, calendar, payment, or communications systems, and AI model providers). We are not responsible for third-party services, and your use of them is governed by their own terms.

10. Disclaimers

Except as expressly stated in an Engagement Agreement, the services and website are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or that AI outputs will meet your requirements.

11. Limitation of liability

To the maximum extent permitted by law, Epic Dreams will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the services will not exceed the amounts you paid to us for the services giving rise to the claim in the twelve months preceding the event, unless a different cap is set in your Engagement Agreement.

12. Indemnification

You agree to indemnify and hold Epic Dreams harmless from claims, damages, and expenses arising from your misuse of the services, your data, or your violation of these Terms or applicable law.

13. Term and termination

These Terms apply while you use our site or services. We may suspend or terminate access for breach of these Terms or as set out in your Engagement Agreement. Provisions that by their nature should survive termination — including intellectual property, confidentiality, disclaimers, and limitation of liability — will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. The parties will attempt to resolve disputes in good faith; any unresolved dispute will be subject to the venue and dispute-resolution terms of the applicable Engagement Agreement, or otherwise to the courts located in Wyoming.

15. Changes to these terms

We may update these Terms from time to time. We will revise the effective date above, and your continued use of the services after changes take effect constitutes acceptance of the updated Terms.
